Broward Court Nepotism - Judge Miette K Burnstein Presides Over Son Mitchell J Burnstein in CRA Case

Broward Circuit Judge Miette K Burnstein presides on unconstitutional eminent domain action brought by her own son, Attorney Mitchell J. Burnstein, for the Pompano Beach Community Redevelopment Agency before later recusing herself. Scandal erupts.
 
June 17, 2010 - PRLog -- The Pompano Beach Community Redevelopment Agency in Broward County, Florida wasn’t a legal agency and didn’t have the power of eminent domain to take properties, even though it had been seizing properties for a decade. How could an illegal agency without the power of eminent domain file an eminent domain action in the courts and succeed in taking property from private citizens for decades? How could this Constitutional offense happen in the United States and how could this not have been stopped before?

Judge Miette K. Burnstein was the Broward County Circuit Court Judge on such an eminent domain case at the beginning of the filing, a case brought by her son, Attorney Mitchell J. Burnstein of Weiss, Serota, Helfman, Pastoriza, Cole & Boniske P.L. on behalf of the Pompano Beach Community Redevelopment Agency looking to seize a multi-million dollar, newly restored historical fashion and entertainment complex owned by Gil Eriksen Properties. Even though the Agency did not even have the power of eminent domain to take properties, and its petition to seize property did not meet the legal requirements or prerequisites of such an action, Judge Burnstein allowed her son’s case to stand, presiding on it for three months before then taking herself off the case.

Speaking of nepotism and conspiracy in the Broward County Court system, Suzanne M. Driscoll of Shutts & Bowen LLP law firm, has commented repeatedly in the past several years that the judge’s son, attorney Mitchell J. Burnstein “has the judges in his back pocket” and with him as an attorney on a case, one “cannot get a fair trial in the Broward County Courthouse.”

Miette K. Burnstein has since retired as a judge. The problems facing her son, the Broward County Courts, and the Community Redevelopment Agency have not ceased, however. As it stands now, the case whereby the property of Gil Eriksen Properties LLC was seized by the Pompano Beach Community Redevelopment Agency with no authority is being seen as Constitutional offense, and is still open and unresolved after five years, which many are calling out as a further obstruction of justice, blockade of due process, and cover-up. The property owner is still owed $4 million dollars in restitution, even though the Pompano Beach Community Redevelopment Agency took possession of the private property four years ago, and has since destroyed it.
