July 20, 2009 - PRLog -- A new study by Dolcera’s Intellectual Property Practice, “Will your patents survive the Bilski Decision?,”  identified the three business domains (Software, Medical Devices & Diagnostics, and Pharmaceuticals) that could be affected by the highest US patent court’s decision: In Re Bilski. The Bilski decision, now under review by the US Supreme Court, questions the so-called business method patents. It is reported that software companies have a sharply higher rejection rate from the patent office, and thousands of business method and software patents risk being invalidated because of this ruling.

Dolcera’s analysis included hundreds of US patent office’s examination reports for method patents in three areas: A. software, B. medical devices and diagnostics, and C. pharmaceuticals. Dolcera’s analysis has established the following:
•   Rejection rates for software method patents are significantly higher since the October, 2008 Bilski decision was announced
•   Medical diagnostics method patents are also affected by the decision, especially those in areas such as telemedicine
•   Pharmaceutical method patents have been impacted, but to a much lesser degree
A senior researcher from a large medical devices company suggests that Dolcera’s research has considerable potential for allaying the speculation that has been surrounding the Bilski verdict. However, the IP community eagerly awaits the Supreme Court’s verdict on this contentious, yet significant issue.
