The FLSA, enacted in 1938, mandates minimum wages, for example, as well as most compensation related details. This same act specifies how employees are to be classified as well, meaning it is not up to the employer. As a result, it is crucial for employers to understand employee statuses thoroughly to both pay employees correctly, and to avoid heavy noncompliance fees.
