Local companies may consider placing an advertisement for any open position in local newspaper publications and should retain proof of domestic recruiting efforts to prove they have made reasonable attempts to find local labour.
In addition, companies may be asked to provide certification stating that “no qualified Indian is available” for the open position, a list of the foreign employee’s qualifications and professional skills may also have to be submitted.
Labour Market testing requirements may apply to both foreign residents’ registration and employment visa extensions. Companies operating in India should be prepared to demonstrate that they have made local recruitment efforts.
