At the preliminary, attorney Green employed an unusual but successful move when he called to the witness stand the client’s parole officer, who happened to be the alleged victim’s close personal friend as well.

Judge Webber said that she found the defense witness “very credible, “ and that in her mind, she could not even determine if the client was anywhere close to the alleged victim when she sustained her injuries.

Judge Webber went on to dismiss the entire complaint, ignoring the San Diego District Attorney Leonard Trinh’s strong objections to her ruling. This was an amazing conclusion, beating three strikes cases at the preliminary hearing are extremely rare events and don’t happen that often.

The state of California is one of the states that have the “three strikes” law. Under the “three strikes law,” any defendant who has two prior “violent” felony convictions can be sentenced to 25 years to life on a third conviction. For many defendants, they can be subjected to the three strikes law even if their third offense isn’t that serious, nonetheless they are still sent to prison because of their previous “two strikes” on their record. If Mr. Green had not been successful at the preliminary hearing, his client could have taken a very different path and faced 25 years in prison instead of walking away a free man.
