Exclusive Distribution Agreements or Anti-Trust and Competition Violation?

Turtle Wax and Other Large Manufacturers of Car Wax and Automobile Appearance Related Products May Be Violating Anti-Trust and Competition Laws
 
Sept. 7, 2008 - PRLog -- BOSTON, MA – An unethical business practice is being performed by some of the world’s largest manufacturers of car wax and automobile appearance related products.

David J. Mazzarella, President and CEO of Mazzarella Car Care, is pursuing this potential monopoly with the Federal Trade Commission to find out if what they are doing is against United States Anti-Trust Laws or a case of mistaken identity of harmless exclusive distribution agreements.

Turtle Wax, Inc. and Meguiar's, Inc. are enforcing exclusive distribution by telling their distributors that they will not be able to carry other premium wax company's products while selling their products. They are also threatening to pull its business from their distributors unless they sign an agreement precluding them from selling other premium brands and of course, most distributors can't afford to stop carrying these very well known brands because they are very large income generating accounts.

This is a violation of the United States Anti-Trust Law which is a body of laws that prohibits anti-competitive behavior or monopoly and unfair business practices.

According to David J. Mazzarella, President and CEO of Mazzarella Car Care, “’Refusal to Deal’ is one of several anti-competitive practices forbidden in the United States which has a free market economy. Agreements involving competitors that restrict the supply of goods are prohibited if they have the purpose of substantially lessening competition in a market in which the businesses operate.”

The Sherman Antitrust Act States: Every person who shall monopolize, or attempt to monopolize, or combine or conspire with any other person or persons, to monopolize any part of the trade or commerce among the several States, or with foreign nations, shall be deemed guilty of a felony.

The only reason you can't find small company’s products on the shelf is because these big corporations want the majority of market share for themselves. They enforce exclusive distribution which suppresses healthy competition amongst businesses and prevents consumers from having a choice of what car cleaning and waxing products they can buy.
