Follow on Google News | False Arrest Lawsuit Filed After Brooklyn Man Arrested for Bicycling While BlackAccording to the Complaint filed in the Eastern District of New York on November 18, 2015, Dequann was riding his bicycle home from a friend's house when a marked NYPD van pulled-up alongside of him and an NYPD officer instructed him to stop his bicycle. Dequann complied with the officer's directives, but queried of the cops, "What is this, stop and frisk," and then stated, "You can't just stop me like this." The officers then demanded his identification which he produced. Thereafter, he was handcuffed and brought to the precinct for processing. Following a twenty (20) hour detention, which included time in Brooklyn Central Booking, Dequann went before a criminal court judge. It was there at his arraignment that he learned what he had been charged with: violating N.Y.C. Traffic Rule and Regulation Section 4-07(c)(3), restricting the driving of bicycles on sidewalks; violating Administrative Code Section 19-176, prohibiting bicycle operation on a sidewalk; and resisting arrest. At arraignment, the matter was adjourned in contemplation of dismissal. Within his lawsuit, Dequann brings causes of action which include unlawful search and seizure, false arrest, failure to intervene and first amendment retaliation.
