Prop 35 Proponents Call 9th Circuit Court Ruling a Disappointment

Safety of California’s Children Takes a Back Seat in Court Decision
 
SACRAMENTO, Calif. - Nov. 19, 2014 - PRLog -- Proponents of Prop 35 released the following statements on a recent decision from the Ninth Circuit Court of Appeals in Doe vs. Harris. The Courts of Appeals issued an affirmation of the earlier district court’s preliminary injunction of one provision of Prop 35. This provision requires that convicted sex offenders provide Internet identifiers to law enforcement.

“We’re obviously disappointed that the court preferred convicted sex offenders’ limited interests in anonymity over the safety of California’s children,” said Chris Kelly of the Safer California Foundation. “This ruling creates a conflict with the 10th Circuit, as well as with existing Supreme Court precedent, and we plan to seek further review.”

Proposition 35 (the Californians Against Sexual Exploitation (CASE) Act) was passed by California voters in 2012 to fight human trafficking and exploitation.

“The online registration provision is a commonsense way to help prevent and solve these crimes. That’s why Prop 35 – which included this provision – received the support of over 10 million California voters and the endorsement of human trafficking survivors, law enforcement, service providers, and elected officials,” said Daphne Phung, Founder of California Against Slavery.

All other provisions of Prop 35 are in effect. The injunction applies only to the one provision that convicted sex offenders provide internet identifiers to law enforcement.
