Attorney Redenburg had first represented Thomas when his former employer denied his unemployment insurance benefits. At the hearing, the employer maintained that Thomas had been fired due to excessive latenesses and therefore, took the position that Thomas was disqualified from receiving benefits. However, the hearing judge found that, "the only evidence of such lateness was a list on a page in notebook kept and prepared by the claimant's market general manager, whose testimony tended to be evasive and at odds with the documentary evidence." Finally, the judge ruled that the Claimant was allowed benefits. After a successful UI Hearing, the client counterpunched and filed a charge of discrimination with the EEOC. Thomas claims that his employer's assertion that he was fired for excessive latenesses was simply pretextual and that the real reason for his termination was because of his perceived disability.
