HERTS, U.K. - Sept. 2, 2014 - PRLog -- In order to cover the costs on flight delay compensation, fares have steadily been rising. Two landmark rulings in June meant that thousands of passengers were able to claim compensation for cases involving technical failures and the Montreal Convention. Since the new ruling, both the Montreal Convention and technical failures can no longer be used by airlines as a defence in court, as they no longer can be considered as an extraordinary circumstance. The first case was between Mr Huzarand Jet.com and the second case was between James Dawson and Thomson Airways. Both passengers won large sums of compensation andthe outcome opened the floodgates for thousands of others.

Since then, Ryanair implemented a Regulation 261 surcharge on all tickets to cover their losses and reportedly increased fares by 12 per cent. EasyJet increased their fares even more, by nearly 20% compared to the previous year. The rising of fares cannot be entirely due to passengers claiming compensation. Ryanair recently removed many of their additional charges to become a more ‘customer friendly’ airline, by doing so it has meant that the airline has to recover money through other means.  It was estimated that on average, fares could rise by as much as £5. However, this shouldn’t stop passengers from claiming back compensation. European regulation 261/2004 is in place to protect passengers when it comes to flight delays or cancellations. Passengers are simply abiding by the regulation and are not abusing their rights. It is the airline’s responsibility to ensure on-time arrival and so when they fail to do so, they should grant flight delay compensation to all passengers affected. It is inevitable that air fares will rise, as airlines have no other way of recovering the costs. Passengers who claim compensation cannot be blamed for any rises in fares. Delays of more than three hours (that qualify for compensation) affect almost 1 per cent of UK flights showing that it is a very small minority of people that are claiming compensation for delays. Passengers do have the right to claim for delays that date back as far as six years due to the statue of limitations that exist within the UK.
