As part of the resolution and in the interests of the general public and to the bicycling community specifically, North County Transit District (NCTD) in good faith and concert with First Transit agreed to further advance its Bicycle Safety Program to ensure its conformance with Federal, State and Local laws.
According to its website, First Transit is the nation’s leading bus transportation provider and the world’s leading transportation corporation.
Mr. Edwards is represented by Richard L. Duquette, Esq., who specializes in advocating the interests of bicyclists and ensuring their safety. His office is located in Oceanside, California. Mr. Duquette believes the integration of required safety advancements in the negotiated agreement with NCTD and First Transit provides an important opportunity for a nationwide, if not global, improvement of bicycle safety considerations by common carriers.
According to Mr. Duquette, “Regardless of compensation, Mr. Edwards’s overriding concern was to ensure that this type of bus accident, which resulted in serious injuries to him and the death of Udo Heinz, could be prevented going forward. This agreement’s provision mandatesNCTD and First Transit’s further advancement of its Bicycle Safety Program. It opens the door for our bicycle community to ensure that its interests are not only considered, but incorporated into the company’s safety policies and procedures.”
The League of American Bicyclists is a national group which promotes the interests of bicyclists. The League’s Bicycle Friendly America program “provides a roadmap for improving conditions for bicycling in communities, states, businesses and universities.”
SDCBC, through Mr. Penseyres’ and Baross’ personal training and instruction, has been involved in NCTD and First Transit’s continuing bicycle safety program. SDCBC intends to “grab the baton” from Mr. Duquette to ensure that buses and other common carriers “Share the Road” with bicyclists on local, national and global levels.
Currently, Mr. Edwards is working towards healing from this crash. Showing gratitude and appreciation for his settlement he offered the following kind words:
