By: Lenco Marine Bennett Marine claimed Lenco Marine, along with company President Richard DeVito Jr., and Rinker Boats infringed on U.S. patent No. 5,113,780. The Court of Appeals for the Federal Circuit in Washington DC has ruled in Lenco’s favor and found that none of Lenco’s products infringed Bennett Marine’s automatic tab retractor patent. The United States Court of Appeals for the Federal Circuit reversed a district court’s earlier findings of infringement, induced infringement, and willful infringement and threw out all money damages that Bennett had obtained. This is a big win for Lenco Marine and company President Richard DeVito, Jr. “These baseless claims started 11 years ago, it’s a great feeling knowing that we persevered in standing for what we knew to be right. We knew we did not violate any patent and continued to appeal to the highest court and ultimately won.
