Research released today by Peninsula Business Services, the employment law firm has revealed 82% of small firms are sacking employees unfairly.

GREATER MANCHESTER, U.K. - May 1, 2013 - PRLog -- In a survey of 535 employees:

- 82% of employers questioned admit they are unsure on how to dismiss workers correctly.

- 77% of those people admit the rules are far too complex hence why they get it wrong.

- 89% of small business owner managers are frustrated that they are unable to dismiss employees immediately.

- Whilst 73% of employers feel that red tape holds back the growth of their business.

Alan Price, Peninsula Group Director said today, “Employers should think before they dismiss, check their policies and procedures are correct then take the proper action. Getting it wrong can result in employment tribunal and may cost the business in terms of both cost and reputation. “

“If underperforming employees are the problem then make sure you provide them with every chance to improve. Also allow them the opportunity to explain why they are underperforming then allow them time to change their ways. If all fails then follow your disciplinary policies and procedures. However do not act hastily, think the process through before taking action.”

Alan Price concludes, “Ensure that both you and your management team are aware of changes in employment law, yes it can be complex but you need to ensure your policies and procedures are compliant. Employees seem to be fully aware of the rules and procedures and it is very easy for a disgruntled worker to take you to employment tribunal. If it’s shown that you have not followed policy then a tribunal may rule against you and award compensation to the disgruntled employee. “

“Whilst red tape is complex it should not be avoided in order to quickly dismiss a disgruntled worker. The Government are to reform tribunal rules this Summer which will help prevent frivolous tribunal claims, we shall await and see what happens.”
