A handful of Douglas County community members sued the Douglas County School District arguing that the Choice Scholarship Program (CSP) was unconstitutional. As of this morning, the Colorado Court of Appeals has ruled in favor of the Douglas County School District and the families participating in the scholarship program. The court's opinion is hinged on the fact that the individuals suing the school district do not have a right to veto a duly elected school board: " We conclude that plaintiffs do not have standing to seek redress for a claimed violation of the Act, and that the CSP does not violate any of the constitutional provisions on which plaintiffs rely. Therefore, we reverse the district court’s judgment and remand the case for entry of judgment in defendants’ favor." "This is a significant victory for parental rights in Colorado," says Karin Piper, spokesperson for Parent Led Reform. "Parents should be able to enroll their children in the academic program they feel is the best fit for their children, public or private. PLR is thankful for the tenacity of the Dougco elected school board that defended the program they created for our families and the community." The duly elected Douglas County School Board is up for re-election November 2013.
