Arizona Publisher & Writer Files 8.8 Billion Dollar Counterclaim against Capital One Bank

Dandelion Books President Carol Adler demands 'authentic proof of an alleged credit card debt' from one of the country's largest credit card companies

Sept. 13, 2010 - PRLog -- Carol Adler, President & CEO of Dandelion Books, LLC and Dandelion Enterprises, Inc., a professional writer and publishing entrepreneur, is demanding that Capital One Bank (USA), N.A., produce authentic proof that she owes Capital One Services for an allegedly unpaid credit card balance.

Adler claims that compensatory, real, and punitive damages against Capital One Bank for violating its charter as issued by the Comptroller of the Currency, are $8, 813,360,000.00.

“After serving me with a default notice six months ago, to which I responded with my request for authentic proof of the alleged debt,” states Adler, “I’m still waiting for that proof.

“Both Capital One Bank and Gurstel, Staloch & Chargo, the Tempe, Arizona based alleged debt collector/attorneys representing Capital One, have ignored my numerous requests. Instead they have continued to harass me with ‘payment options.’

“Finally, they snowed me with photocopies of past credit card statements and a promissory note signed when CAROL E. ADLER first opened the $1,000 alleged credit card account in 1997.”

Either they have something to hide, claims Adler, or the original mutually signed contract between CAROL E. ADLER and CAPITAL ONE BANK (USA), N.A., stating that CAPITAL ONE BANK deposited legal tender or actual money/gold/bullion in an account bearing the name CAROL E. ADLER, does not exist.

“Clearly, what has never existed cannot suddenly manifest itself out of thin air,” Adler points out. “A signed promissory note to pay back alleged credit is not a mutually signed contract that shows proof of a bank ‘line of credit’ for CAROL E. ADLER. Moreover, it is illegal for National Association banks to lend credit.”

Included in Adler’s damages counterclaim in addition to Capital One (USA) Bank, N.A. and each of the Gurstel, Staloch and Chargo attorneys whose names appeared on alleged plaintiff documents, are: Richard D. Fairbank, CEO of Capital One Financial Corporation, Inc., the Delaware registered holding company for Capital One Bank (USA), N.A.; and other debt collection companies that previously attempted to collect the alleged debt—NCO Financial Systems, Inc., Regional Adjustment Bureau, Inc., MRS Associates, Inc., and Capital One Services, LLC.

On September 9, 2010, the case was ordered transfer from the Maricopa County Justice Courts of Arizona to the Maricopa County Superior Court.
