By: Lars Soreide, Esq. The key areas of concern for of the Board and the Florida Bar is past substance abuse, prior criminal records, lack of candor and with increasing frequency financial irresponsibility. Financial irresponsibility has been on the rise with the increase in home foreclosures and bankruptcies. The importance of candor cannot be overly emphasized in dealing with the Florida Bar and the Florida Bar Examiners says Lars Soreide. “The need to be candid in your dealings with your law school, candid with the Florida Board of Bar Examiners, candid with creditors, and candid in all your personal and professional communications can’t be emphasized enough.” There has been a recent rise in applicants being called in for a hearing who failed to timely amend their law school application. Most applicants remain current with their amendments on their Florida Bar application but fail to remember their duty to keep their law school application current which shows lack of candor to the Florida Bar. It is very important to carefully review your law school application with a trained legal professional who regularly deals with the Florida Board of Bar Examiners. Investigative Hearings are on the rise and carefully reviewing the instructions and especially for items 19-23 are key to the possibility of avoiding a hearing. Soreide Law Group also offers a bar application review and background check service. Lars Soreide recently represented an applicant at the Tampa investigative hearings where an applicant failed to disclose a brief hospitalization for alcohol poisoning. A casual reading of the Florida Bar Application would lead one to believe that the Board was seeking to illicit if the applicant had ever been treated for alcohol abuse. However, a careful reading of the question does encompass ending up in the hospital for 6 hours to be treated for alcohol poisoning or alcohol related dehydration. According to the Board of Bar Examiners the brief hospitalization was in fact a hospitalization and treatment for alcohol abuse and needed to be disclosed.
