The Road Traffic Lawyer Successfully Defends Apprentice Candidate

The certificate of accuracy document should prove an essential fact of the Crown case, namely the accuracy of the technique used to measure the speed. Normal practice would be to challenge this document and force the Crown to prove this essential fact. However, juggling a busy travel schedule around the UK meant that the certificate had been served without the client’s knowledge.

On the day of the trial, the Road Traffic Lawyer was forced to advise his client that they were in trouble. Although, as many of our clients have discovered, nothing ventured, nothing gained and the case proceeded to trial. This was a remarkable result in light of the problem caused by the unchallenged certificate of accuracy.

This was a “blood and guts” defence and only those truly experienced in road traffic law in Scotland would understand how a case that was essentially self-proving was deemed to lack evidence.
