Follow on Google News | District Judge Pollard and The Impossible Court OrderDistrict Judge Pollard made a Court Order in the Hastings County Court, England that has proved to be near impossible to honour. Several years later the effects are still being felt by the respondent in this case in both financial and health terms.
By: Injustice in Europe A divorce settlement hearing, case no. HS03D00476, dealt with the estate of the divorced couple. Effectively the respondent needed to sell the jointly owned property in order to comply with the order. However, the casual reference to the property to be sold, which in fact is four properties, is unacceptable to the Spanish Courts who have been asked to uphold the order. The Spanish judge demands more than mere house numbers to identify the properties in question. They needt the English court to reword the order correctly. Hastings County Court have been given the correct form of describing the property and asked to reword the order accordingly. To date have not done so. Until that happens, District Judge Pollard's court order is impossible to implement and blame is being directed towards the respondent whose health and finances have been adversely effected by the whole proceedings. The respondent has tried on many occasions over the years to honour the order by selling the jointly owned property. Five buyers have been found and yet on every occasion he has been denied the opportunity to sell either by the incorrect wording of the order or the petitioner’s lawyers, De Cotta McKenna & Santafé, who relied on the mis-translated order provided by Sworn Translator, Barry True. The latest sale that has fallen through is today, 23 August, as the buyer from South Africa has informed the respondent that she can no longer wait for Hastings County Court to meet the requirements of the Spanish Court. Another sale is lost and with it the opportunity to honour the impossible court order of District Judge Pollard. Under the circumstances, Injustice in Europe asks, did the judge in fact have jurisdiction in this case and what responsibility will the judge take upon himself for the suffering caused to the respondent?
