Today's Transgender Ruling to Hurt Women's CollegesBarnard, Mt Holyoke, Simmons, Smith, and Wellesley Facing Title IX Complaints
Each of these women's institutions is now faced with at least one Office for Civil Rights [OCR] complaint that it is engaging in illegal sex discrimination, in part because it admits males], and then has them compete in sporting events against its female students: ■ Barnard College - 02-26-2340 ■ Mount Holyoke - 01-26-2245 ■ Simmons University - 01-26-2246 ■ Smith College - 01-25-2398 ■ Wellesley College - 01-26- OCR has already concluded that:"Title IX contains a single-sex exception that allows colleges to enroll all-male or all-female student bodies—but the exception applies on the basis of biological sex differences, not subjective gender identity. An all-girls college that enrolls male students professing a female identity would cease to qualify as single sex under Title IX. [emphasis added] As the Supreme Court ruled unanimously today, permitting males to compete against females creates a major risk of physical injury, See, e.g.: [emphasis added]: ■ "the Court must recognize the distinctiveness of competitive sports—and the safety and competitive fairness issues that can arise when females are forced to compete against males" ■ "some biological males who identify as female have sought to play on women's or girls' sports teams. That modern development has triggered national and international concerns about safety and competitive fairness for female athletes" ■ "Given the inherent physical differences between the sexes, allowing only biological females to play on women's and girls' teams can reduce the risk of physical injury and ensure fair competition" ■ "With respect to safety, allowing biological males to play on women's and girls' sports teams can put women and girls at significant risk of injuries. The safety risks are particularly severe in contact sports." The majority concluded: The safety risks are at their apex in contact sports, such as soccer, basketball, field hockey, lacrosse, and ice hockey, among others. And safety concerns also exist in ostensibly non-contact sports,[emphasis added] As Professor Banzhaf has documented and argued to the OCR, prohibiting males from attending all-women's colleges would help address the problem of females being forced to compete against M2F transgender athletes in women's sporting events; a controversial practice, also separately under legal attack, which is allegedly both unfair and dangerous to female competitors.
