Hosts - Protect Yourself From Thanksgiving Day Lawsuits

Download a Free Guest Liability and Indemnification Agreement

WASHINGTON - Nov. 24, 2025 - PRLog -- If you are concerned about lawsuits generally, and/or you are especially worried about serving Thanksgiving dinner to a lawyer or law student, you can download, for free, a
Thanksgiving Guest Liability and Indemnification Agreement (https://consumerfreedom.com/articles/143-thanksgiving-guest-liability-and-indemnification-agreement/)

Here's a bit of what it says:

"Guest acknowledges and understands that no warranty, either expressed or implied, is made by the Host as to the nutritional content of the meal.
This document is offered in order to duly warn Guest that dangerous conditions, risks, and hazards may lurk in the turkey, stuffing, vegetables, cranberry sauce, fixings, drinks, desserts, appetizers, and any other comestibles that may be served.monounsaturated fat, peanuts, sugar, alcohol, tryptophan, caffeine, and good cheer.
Guest acknowledges that eating may incur risks including, but not limited to, satiation, indigestion, heart burn, dizziness, laziness, heart disease, holiday spirit, "food coma," and "that bloated feeling."
As consideration for being allowed by host to enjoy a Thanksgiving meal, Guest hereby indemnifies Host from all liability for personal injury suffered by Guest - which may be caused, in whole or in part, by any element of Host's meal.
Guest has read this document and understands it. he/she is signing it freely and voluntarily, and promises not to appear as a witness in support of John "SUE THE BASTARDS" Banzhaf, Esq., at any time in the future."

It's obviously tongue in cheek, and was put together by an industry group upset with the successes public interest law professor John Banzhaf and his law students were having in suing food giants such as McDonald's (which settled for over $12 million) - Using Legal Action of Fight Obesity (http://banzhaf.net/obesitylinks.html) - for various misrepresentations and deceptive tactics used to promote its food offerings.

That publicity stunt inspired a restaurant to require a legal liability waiver to eat "THE BULGE," (https://www.washingtonpost.com/archive/politics/2003/09/2...) which in turn triggered congressional testimony (https://www.govinfo.gov/content/pkg/CHRG-108shrg93314/html/CHRG-108shrg93314.htm).

The same industry-front group also produced a brief video clip of the "trial" by an obese litigant and a money-hungry shyster lawyer against a very young girl scout for selling a tasty cookie.

Their attempt to use humor in a loosing battle against those using legal action to fight America's epidemic of obesity didn't work, and Professor Banzhaf went on to be called "the Ralph Nader of Junk Food," "The Man Who Is Taking Fat to Court," "The Man Big Tobacco and Now Fast Food Love to Hate," the lawyer "Who's Leading the Battle Against Big Fat," and "a Major Crusader Against Big Tobacco and Now Among Those Targeting the Food Industry,"

So, says the professor, have a Happy Thanksgiving and worry more about possible overeating than imaginary lawsuits by your Thanksgiving guests.
