EPA has a very fishy problem in the California Delta

SAN FRANCISCO - Sept. 24, 2025 - PRLog -- San Francisco, CA  — A federal lawsuit filed by Point Buckler Island owner John Donnelly Sweeney is pulling back the curtain on a quarter century-long environmental funding scandal that has diverted billions of federal dollars from EPA and NOAA into phantom "restoration" projects for the now-extinct Delta smelt for a quarter century.

According to Sweeney's filings, for more than 25 years the Environmental Protection Agency (EPA) and its partners claimed to have built over 50,000 acres of salmon and smelt habitat across the San Francisco Bay-Delta. In reality, independent audits uncovered only 12,000–14,000 acres of CEQA-compliant restoration — leaving tens of thousands of acres unaccounted for and billions of dollars in question.

"This was sold to the public as grants to build habitat for endangered fish," said Sweeney. "But the smelt went extinct in 2017, and the money kept flowing. It looks more like a USAID pass-through than real conservation."

A Landmark AI-Drafted Whistleblower Case

In April 2025, Sweeney and his wife, Jennifer Frost, filed Sweeney v. Carringer (Case No. 4:25-cv-03148-JST, N.D. Cal.), a sweeping federal RICO and civil rights suit against 38 defendants, including senior state and federal officials, judges, NGOs, and environmental consultants in their personal capacities. The 665-million-dollar case has already broken new ground as the first federal civil RICO action drafted entirely with GROK AI legal assistance.

The lawsuit alleges that two of Sweeney's privately owned islands — Point Buckler Island and Chipps Island — were unlawfully seized through rigged court proceedings, rigged auctions to cover up phantom restorations projects listed in the EPAs own database called EcoAtlas run by Non-Profit San Francisco Estuary Institute.

Judge Weighs Next Steps

The case is currently before U.S. District Judge Jon S. Tigar in San Francisco. Over 260 motions have been filed, but notably, none of the defendants have directly rebutted the whistleblower allegations of fraud, bid-rigging, or falsified restoration data. Judge Tigar is expected to rule shortly on whether the case will advance to discovery.

In parallel, Sweeney confirmed that a Washington, D.C. law firm has agreed to assume lead representation as the case moves forward, replacing his AI-driven filings with full trial-level litigation.

Call for Federal Oversight

The whistleblowers Sweeney and Frost are calling on EPA Administrator Lee Zeldin and Trump's Department of Government Efficiency (DOGE) task force to launch immediate federal audits into all Bay-Delta habitat restoration projects and funding since the late 1990s.
