Unbiased Outside Investigator Required by Federal Law to Avoid Conflict of Interest
 
WASHINGTON - May 26, 2025 - PRLog -- The first step in the process to determine whether federal crimes were committed as part of the process of covering up former President Joe Biden's physical and mental decline has been taken with the filing of a formal Part 600 legal petition for the appointment of a special counsel to conduct a criminal investigation; an appointment which is required by federal law to prevent a "conflict of interest."

Senator John Cornyn has called for the Department of Justice a "to conduct a full [criminal] investigation and ensure that no federal laws were violated during the previous administration"

Both President Donald Trump and Representative James Comer, Chairman of the House Oversight Committee, have suggested that White House aides took advantage of Biden's cognitive difficulties to use an autopen to sign pardons which Biden had not approved.

So Comer, who also claimed "the Biden White House obstructed the Committee's investigation," and Senator Ron Johnson, the Chairman of the Senate Permanent Subcommittee on Investigations, are both planning congressional hearings about the Biden health coverup

But congressional hearings are no substitute for a criminal investigation by a skilled prosecutor, says public interest law professor John Banzhaf, whose public interest legal actions helped obtain special prosecutors for Richard Nixon, and an order requiring the appointment of an independent counsel.

The list of federal crimes which may have been committed includes possible falsification of government documents, lying to federal agents including members of Congress, obstruction, and even the unauthorized use of an autopen to grant pardons or possibly take other actions without Biden's knowledge or permission.

More importantly, an investigation of the former vice president and other key members of the opposing party by the Department of Justice [DOJ] itself would create a clear and unavoidable conflict of interest.

That's why federal law requires that the investigation be conducted by a special counsel - more specifically it requires "a lawyer with a reputation for integrity and impartial decisionmaking" who shall be "from outside the United States Government" - whenever an investigation is warranted, but where one conducted internally by the DOJ "would present a conflict of interest."

That's why the need for the appointment of a special counsel was first pointed out by former deputy assistant attorney general and now law professor John Yoo, and then adopted and publicized by attorney and Fox News Host Kayleigh McEnany, says Banzhaf, who frequently does not agree with them regarding other issues.

Indeed, Banzhaf can hardly be accused of being in Trump's camp since he filed the legal complaint which led to the criminal investigation, and subsequent indictment in Georgia, of the 45th President.
