The Plaintiffs are seeking relief that will bring Mercer County Board of Elections' practices in line with Title 19 and the Constitution, such as ending the practice of making qualified voters vote by provisional ballot when a machine malfunctions and then rejecting the ballot due to having "voted by machine." 749 voters had their votes improperly rejected in 2022 due to this practice, and Mercer County Board of Elections has continued the practice into 2024 as recently as the June primary elections. Counts 1 and 2 against the six individual defendants in their individual capacities will continue. Count 3, the declaratory judgment against all parties continues. The declaratory judgment count seeks a legal determination regarding the parties' rights and responsibilities.
