PRLog -- The first decision to halt sales of the Apple Series 9 and Ultra 2 watches in the United States was issued by the United States International Trade Commission (ITC) after the ITC decided Apple infringed two patents owned by health tech business Masimo Corp. (MASI). A sensor is used in the patented method in question to assess blood oxygen levels.
The Office of the United States Trade Representative said on Tuesday that the US government will not intervene to overturn the embargo. The United States Trade Representative, Ambassador Katherine Tai, said that "after careful consultations,"
she chose not to alter the ITC verdict, making it official.
Apple said that it strongly disagreed with the ITC finding and the subsequent exclusion order, and that it will appeal the case to the United States Court of Appeals for the Federal Circuit. Furthermore, the corporation filed an emergency petition, requesting that the prohibition be lifted until the matter is heard.
Apple's stock fell marginally on Tuesday. Masimo's stock increased by more than 2%.
