Claiming Trans Status, Rapist With Penis Was Sent to a Women's Prison

WASHINGTON, D.C. (January 30, 2023) - A man convicted of two different brutal rapes was sentenced to serve out his sentence in an all-female prison simply because, and only after his criminal conviction, he suddenly and unexpectedly claimed to feel like a woman.

This occurred although his estranged wife warned that the alleged transition was a "sham for attention," and he was "bull******** the authorities" to avoid a male prison.

It's a crazy decision based upon being oversolicitous for the concerns of persons who are truly transgender, says public interest law professor John Banzhaf.

Putting a convicted rapist still sporting a functioning penis into a women's prison is like letting him shoot fish in a barrel with so many potential rape victims all around him in situations where they may not be able to effectively complain or defend themselves, the professor warns.

In general, it probably would be much better for any male convict (a robber as well as a rapist) to be confined with women rather than men since he would be largely protected from the rapes and physical beatings which are reportedly endemic in many male prisons, and be surrounded by women who have virtually no other male companionship.

This should not be the reward offered for any male felon willing to claim to be a M2F transgender person, argues Banzhaf.
But this overzealous concern for genuine transsexual felons is also occurring in the U.S.

For example, just last year an inmate claiming to be M2F transgender had to be transferred out of the only women's prison in New Jersey after he impregnated two female inmates, and probably had sex with others.

In many states, prisoners claiming to be M2F transsexuals are housed in women's prisons, even though they often still have fully functioning male organs, and may well have a strong desire for sex with their fellow female convicts.

Indeed, even a legitimate M2F transsexual prisoner with a penis may experience a strong desire to have sex with women, since true transgender women can be lesbian or bisexual as well at heterosexual.

So, while states should not ignore the real concerns of legitimate transgender prisoners, rewarding any man willing to simply claim a female persona (without any proof or checks), with a berth among hundreds of women eager for male companionship, is a flawed system akin to putting a fox inside the chicken coop, and making it possible for him to shoot the female fish in a prison barrel, argues Banzhaf.
