National Merit Scholars May Sue Virginia School Boards

Class Action Lawsuit Could Provide Compensation and Deterrence
 
WASHINGTON - Jan. 23, 2023 - PRLog -- High school students at some 17 schools in 3 Virginia counties may bring a class action lawsuit against the high schools which denied them opportunities for admission to top universities and scholarships by deliberately refusing to tell them they had won National Merit Scholarships, says public interest law professor John Banzhaf.

Although some attorneys in private practice are reportedly considering bringing civil lawsuits on behalf of the students - for discrimination based upon race under state and federal anti-discrimination laws and/or under the Constitution - such tort suits might not be the best way to proceed, says Banzhaf, who has been called a "King of Class Action Lawsuits."

Also, any legal action premised on alleged discrimination against students of Asian descent would not result in any compensation for student scholars of other races.

So the law professor, who masterminded successful novel law suits against the major tobacco companies, McDonald's, Spiro T. Agnew, and many others - including over 100 successful anti-discrimination legal actions - suggests that a few students will step forward and bring a class action civil law suit.

As various legal scholars have explained, "Prima facie tort also can encompass situations that would fall into exceptions to traditional torts."

Banzhaf is so well known for developing novel and outside-the-box legal theories and causes of action to win cases with unusual and/or difficult fact patterns that he has been called "Legal Academia's Instigator in Chief," an "Entrepreneur of Litigation, [and] a Trial Lawyer's Trial Lawyer."

Now he's seeking to encourage a class action lawsuit on behalf of all the Virginia victims of the newest "woke" outrage; deliberately denying many students the opportunity to apply in time for admission to top universities and for scholarships, all in a misguided effort to achieve "equal outcomes for all students."
