Fighting the Governor's Executive Orders on COVID in Hawaii

Attorney Marc J. Victor recently argued at the Hawaii Court of Appeals that the Hawaii Governor's endless emergency proclamations over COVID are illegal and unconstitutional.
 
HONOLULU - Feb. 14, 2022 - PRLog -- Attorney Marc J. Victor recently argued at the Hawaii Court of Appeals that the Hawaii Governor's endless emergency proclamations over COVID are illegal and unconstitutional. Governor Ige's emergency proclamation was supposed to expire after 60 days, at which point the legislature should get involved to decide when an emergency is no longer an emergency. But it would seem Governor Ige would like to have sole discretion to make this decision by declaring another emergency after another emergency on exactly the same facts.

Attorney Victor points out that the governor should not have this unchecked power, and that the legislature should get involved after 60 days. The legislature should be the ones to decide when the emergency is over, not the Governor in his sole discretion. The legislature is the voice of the people and should be the ones to make the decision, not the governor. This is how our system of government works. We don't give dramatic expansive powers to one person and then allow this person in their sole discretion to decide when to relinquish that power.
