Dr. Rajan Mahtani To Remain The Legal Owner Of Portland Cement, Announces Supreme Court

LUSUKA, Zambia - Dec. 7, 2020 - PRLog -- In another historic event, the Supreme Court Zambia threw out an appeal made by the Ventriglias. In their appeal, the Ventriglias challenged the decision from the higher Court of Appeal of 31st January 2019. In this date, justice Mwinde on behalf of the higher Court of Appeal had announced the judgement for the Portland Cement Zambia case. In his judgement, justice Mwinde confirmed that the Portland Cement Zambia factory belonged to Dr. Mahtani owned Finsbury Investments based on the 58 percent shares owned by Finsbury Investments. However, the Ventriglias tried to again disrupt the peace finally achieved by Portland Cement Zambia.

In a recent appeal made to the Supreme Court Zambia, the Ventriglias family challenged the previous judgement made by the higher Court of Appeal. In their appeal, the Ventriglias claimed that the decision by justice Mwinde of Court of Appeal was unjust. Their appeal also included reversal of the amount payable by Finsbury Investments against the 58 percent shares owned by them. In their appeal, the Ventriglias claimed that the actual amount payable is not K580,000 but K580 million.

The Supreme Court established a bench comprising of three judges for evaluating the validity of this claim by the Ventriglias. After evaluation, the judges announced that the claim was beyond their purview to accept since appeals against previous court decisions must be made within one week of the decision itself. However, the Ventriglias came with their appeal more than a year later and therefore, the appeal is legally not viable.
