-- The case of Portland Cement Zambia can be easily described as one of the longest for Dr Rajan Lekhraj Mahtani. This case was initially registered by Dr Rajan Mahtani himself at the Lusaka High Court, claiming that his factory was unethically taken over from him. Significant evidences were shared before the court and despite these strong evidentiary support, the case verdict remained pending for more than a decade. Justice Nkonde on behalf of the Court gave the final decision in the year 2017. However, this decision from the Lusaka High Court was misdirected as Justice Nkonde announced Ventriglias as only shareholders of the Portland Cement Zambia.
To challenge this misdirected decision, another appeal was made to the higher Court of Appeal. Justice Mwinde took over the case at the Court of Appeal and after nine months of court proceedings, announced the final decision on the case. According to this verdict, Dr. Rajan Mahtani made a payment of one billion kwachas to the Portland Cement Zambia limited in the year 2005. Furthermore, the stakeholder agreement also confirmed Dr. Rajan Mahtani's legal payment for controlling 58 percent stakes at the Portland Cement Zambia. Based on these evidences and several other testimonials, it was finally announced that Dr. Rajan Mahtani is the actual owner of the Portland Cement Zambia factory.
Justice Mwinde also condemned the decision from the Lusaka High Court judge on Portland Cement as it was given without looking into evidences and testimonials.
