-- After several proceedings, the higher Court of Appeal made a final announcement on 31st January 2019. This announcement comes more than a decade after Dr. Rajan Mahtani launched a case at the Lusaka High Court with claims of unethical takeover of his company. It is interesting to note here that despite taking more than ten years to come at a judgement, justice Nkonde from the Court of Appel gave a misdirected and unethical verdict. Another interesting fact related to the Lusaka High Court is that around two months before giving the final announcement, justice Nkonde confirmed that he is closing all court proceedings and based on the evidences provided by all parties, final decision will be given. This was an extremely positive news for Dr. Rajan Lekhraj Mahtani as his evidences and testimonials were more than enough for confirming his claims.
However, the final decision from the Lusaka High Court surprised everyone. Justice Nkonde announced Ventriglias as only shareholders which was misdirected and against all the evidences submitted. The most surprising fact is that the Ventriglias did not had any concrete evidences to support their claims.
Nevertheless, Dr. Rajan Mahtani rightly approached the higher Court of Appeal after this fiasco and was given justice rightly after with confirmation that he paid one billion kwachas for gaining 58 percent shares of the Zambezi Portland Cement factory and is the rightful owner of the Portland Cement Zambia factory.
