-- It is the duty and prime responsibility of the legal and judiciary systems of any state or nation to provide judgement based on facts and not on the basis of false pretexts or favours. It is big crime for any judge to overlook the evidences and give misdirected judgement. However, that is exactly what happened in case of the Lusaka High Court which took more than a decade to provide final verdict for the Portland Cement Zambia case which was then found to be misdirected, unethical and given without any evidences. Justice Nkonde on behalf of the Lusaka High Court announced the Ventriglias as only shareholders of the Zambezi Portland Cement and considering the fact that this verdict was extremely unjustified, Dr. Mahtani was left with no other option than to approach the higher Court of Appeal.
The higher Court of Appeal is among the mots respected and highest legal systems within the nation. Expectations were high from the Court and it did not disappoint a bit. The court proceedings were quick and transparent and the judge at the higher Court of Appeal did not take much time to announce the final verdict. According to this final verdict, Dr. Rajan Lekhraj Mahtani is the actual owner of the factory as he has paid one billion kwachas to the Zambezi Portland Cement for covering the value of the entire share capital of the cement factory. The evidences from the shareholders' agreement established in 2007 further confirms these claims and also establishes the fact the Dr. Mahtani has completed all the payments associated with his terms and is not liable for further costs.
While one court took a decade to announce a decision which was plain wrong, the other court provided a quick and transparent judgement. These are points to ponder.
