Orange County Nursing Home Elmcrest Care Center, LLC At Center of Suit for Patient Abuse

LONG BEACH, Calif. - Feb. 11, 2020 - PRLog -- While recovering from hip surgery, a patient at Elmcrest Care Center, LLC did not expect to leave the facility with one newly-fractured hip and his healing hip shattered by the impact of a fall.  However, the plaintiff, in a new lawsuit filed by elder defense firm Garcia & Artigliere, is accusing the nursing home of failing to provide proper care and supervision despite personnel's knowledge of his fall risk and his resultant need for continual assistance.

As a result of a fall he experienced during his time in residence at Elmcrest Care Center, the plaintiff required surgery on his left hip and a full replacement of his right hip.  He is currently undergoing extensive rehabilitation to regain his ability to walk.  The plaintiff contends his fall was the sole fault of the facility, which was insufficiently staffed at the time of his stay.  Further, after multiple near- and actual falls, nursing staff should have informed his family and physician of the problem and increased their level of supervision or recommended his transfer to a facility with enough resources to care for high-acuity patients.

The plaintiff is requesting damages for actual medical costs, legal expenses, and the pain and suffering, both physical and mental, the incident caused.  He alleges the facility's management was negligent in many ways: Management failed to hire sufficient and well-trained staff; provide ongoing education for staff members; and address prior complaints brought by wrongfully injured patients.  He holds the devastating fall, which negatively impacted his quality of life in a lasting way, would have been prevented by a higher level of supervision.  Finally, he alleges Elmcrest Care Center was overseen by an entity not licensed to do business in the state of California.
