After Patient Death, Garcia & Artigliere Helps Family File Lawsuit Against Santa Teresita Manor

By: Garcia & Artigliere

DUARTE, Calif. - Dec. 18, 2019 - PRLog -- In their newest suit, Garcia & Artigliere alleges negligent hiring practices and repeated violations of the duty of care caused unnecessary pain and suffering to a patient at Santa Teresita Manor.

The suit lays out a pattern of alleged mismanagement that enriched the facility owners at the expense of many high-need patients in residence at Santa Teresita Manor.  Despite paying $8,000 a month to receive care during her battle with pancreatic cancer, the patient at the center of this suit saw her needs ignored.  By any reasonable standard, she would have been considered high risk for the development of pressure sores (also known as bedsores).  Their failure to provide her with preventative care resulted in serious injury.

Typically, when a patient develops a Stage IV pressure sore, they will be taken to the hospital for treatment.  Not only did the caregiving team at Santa Teresita Manor fail to prevent a pressure sore from developing and progressing to Stage IV, but they also failed to seek proper care when the injury worsened.  Santa Teresita Manor hid the evidence of the pressure sore from the patient's family, legal representative, and physician.  When her condition became apparent, her physician prescribed morphine for the intense pain caused by a Stage IV pressure sore; the facility allegedly allowed only half the recommended dose for the patient, prolonging her pain and suffering.

The difficulties visited upon the patient in this suit were not due to a one-time mistake: They were the consequence of routine neglect and maltreatment by the facility.  Garcia & Artigliere therefore also allege Santa Teresita Manor:

·         Did not have sufficient staff to meet patient needs

·         Did not implement regular training as required for caregivers in a nursing home environment

·         Either negligently or willfully hired staff who were unfit to provide the care needed by residents

On behalf of the patient affected by this facility's mismanagement, Garcia & Artigliere asks the Court of Los Angeles to award damages to her survivors.  The patient's unnecessary pain and suffering decreased the quality of the last few months of her life and led to the continued decline of her condition.
