Garcia & Artigliere Filed Elder Abuse Complaint Against Terraces at San Joaquin Gardens in Fresno CA

FRESNO, Calif. - Dec. 12, 2019 - PRLog -- Terraces at San Joaquin Gardens is considered a licensed Residential Care Facility for the Elderly (RCFE) by the state of California. RCFE locations are not legally permitted to provide medical care and are prohibited from accepting residents who have certain conditions (including dementia) or are completely dependent on others for their daily needs.

The victim in this case was an 87-year-old woman who was admitted to Terraces at San Joaquin Gardens in 2012. During her stay in the facility, she became dependent on staff due to her declining mental and physical condition. She had moderate dementia and was observed by facility staff to be at high risk for falls. In October of 2019, her family was informed by a facility employee that they were planning on installing a bed alarm in her room because she would get up without her walker during the night. Allegedly, the alarm was never installed.

The victim's deteriorated mental state and increasing dependence on facility staff categorized her as unfit to live in a non-medical Residential Care Facility for the Elderly. Despite the facility's knowledge of this, the victim continued to stay at Terraces at San Joaquin Gardens.

To address injuries caused by a fall in early November of 2019, the victim was transferred to St. Agnes Medical Center where doctors identified brain bleeding, a broken jaw, and a broken cheekbone. She was unable to undergo surgery for the bone fractures due to her age and medical state, and was discharged to her home. Approximately a week after the fall that caused her injuries, she passed away.

The complaint alleges that the victim's injuries, suffering, and eventual death were a direct result of inadequate staffing and resources at Terraces at San Joaquin Gardens and attempts by the defendants to increase their profits.
