Garcia & Artigliere Uncovers LLC Scheme Responsible for Patient's Stage IV Pressure Sore

LA MESA, Calif. - Oct. 29, 2019 - PRLog -- After having his entire leg amputated at the hip, a dependent adult checked in to Community Care Center, owned and operated by Jacob Graff through his shell company, Premier Facility Intercompany, and its constituents, which include Community Convalescent Hospital of La Mesa, LLC, PREMIER B.H., Inc., and DOES 1-50.

While the plaintiff resided in Community Care Center, the 119-bed, 24-hour skilled nursing facility made false "lease payments" totaling $780,000 to Community Convalescent and paid another $864,000 to PREMIER for "administrative services." Additionally, Community Care Center, hereby known as "the facility," claims to owe Premier Facility Intercompany a debt of nearly $6 million, even though the shell company and its many branches provided nothing of value to the facility.

The plaintiff was admitted to the facility in Dec. 2018 due to his aforementioned amputation, failing health, and bone infection. He was clearly at risk for pressure sores, but his needs were neglected entirely. The facility was severely understaffed and existing employees were untrained and unqualified.

Employees of the facility failed to keep the plaintiff hydrated and properly nourished and did not adhere to standards of sanitary care. Further, the patient was offered no relief from his pressure sore, even as it became ulcerated, pus-infiltrated, blood filled, festering, and necrotic.

By the time the patient was transferred to another facility in July 2018, he had developed a horrific stage III pressure sore on his ischial femur, along with several other lesions. He received treatment and resided at Sharp Grossmont Hospital from Sept. 2018 until his transfer to Jacob Health Care Center, a "related" facility owned and operated by Jacob Graff, in Jan. 2019.

In July 2019, the patient was taken to the UCSD Medical Center for a previously scheduled surgery. His pressure sore was never allowed to heal properly and had deteriorated into a stage IV decubitus ulcer by the time he arrived. This complication, exacerbated by Jacob Heath Care Center, delayed his scheduled surgery. The patient also required a separate, otherwise unnecessary, and extremely painful surgery to resolve his stage IV bedsore.

Jacob Graff illegally refused to home the patient after his surgeries. Since late Aug. 19, the plaintiff has been a resident of Select Specialty Hospital.

On behalf of the plaintiff, Garcia & Artigliere is suing Jacob Graff and his entities for causing the plaintiff's injuries, and for negligent hiring and supervision. The plaintiff hopes to be awarded general, special, punitive, and exemplary damages, and be reimbursed for attorney fees and costs of suit.
