Because of this condition, he was rendered dependent on others for activities of daily living (ADLs). Despite knowing that the plaintiff was especially vulnerable to injury and infection, the facility staff did not provide proper medical care or supervision when the plaintiff started to complain of excessive thirst, severe constipation, and stomach bloating. After ten days of receiving inappropriate treatment for his illness, the plaintiff became seriously ill – and his family specifically requested his transfer to Mission Community Hospital, where he was diagnosed with a dangerous C. Difficile infection. Because of the extended delay in diagnosis and treatment, he was given only a 10% chance of survival. Even after surviving the first infection, the plaintiff began showing signs of C. Difficile yet again, but the facility refused to send him back to the emergency room for further examination. After multiple requests from the plaintiff's family, he finally received a second round treatment for C. Difficile.
