Garcia & Artigliere File Complaint Against the Rehabilitation Center of Santa Monica

LONG BEACH, Calif. - Aug. 6, 2019 - PRLog -- Garcia & Artigliere has filed a complaint against the Rehabilitation Center of Santa Monica Operating Company, LP and other affiliated entities for providing substandard custodial care that resulted in the death of a resident. The complaint was filed on behalf of Edna Todd McKinney, deceased, and her Successor in Interest, Sherwin Uyalor, based on two causes of action: elder abuse and negligent hiring and supervision practices.

Edna McKinney was admitted to the Rehabilitation Center of Santa Monica in March of 2016. The neglect she suffered for three years resulted in serious medical conditions that were never acknowledged or treated by the staffers. The complaint also alleges that the facility failed to notify the plaintiff's family and physician about her condition, which is a direct violation of state and federal nursing home regulations. Edna McKinney didn't receive treatment for her injuries until February 2019, when she was checked into St. John Hospital and diagnosed with a urinary tract infection, dehydration, sepsis, and malnutrition. She never recovered from these injuries and passed away on March 23, 2019.

Over the years, the Rehabilitation Center of Santa Monica has been issued several deficiency citations for failing to provide a reasonable standard of care to its residents. The complaint maintains that the corporate officers, directors, and managing agents purposely retained as many residents as possible for the purpose of generating revenue. However, despite maximizing the facility's daily profitability, management failed to adequately staff the facility itself, a common nursing home issue that frequently leads to deficiencies in patient care and resident fatalities, such as the loss of Edna McKinney. In fact, management has been siphoning funds and resources directly from the facility for non-clinical "phantom services" that lack a paper trail. Because these funds are diverted to common owners of various entities, the Rehabilitation Center of Santa Monica lacks the staff and resources to provide each resident with the care their respective conditions require.
