By: Imbesi Law, P.C. The FINRA broker's Form U5 initially listed a customer complaint alleging that the investment product recommended by the broker was not suitable for the client. This negative information was publicly viewable on BrokerCheck and the FINRA broker's Form U5. The FINRA broker filed a claim for arbitration requesting expungement of the customer complaint from his Form U5 and BrokerCheck report. Attorney Israel Klein, of the law firm Imbesi Law P.C., represented the FINRA broker throughout the arbitration process and successfully obtained expungement of the FINRA broker's Form U5 following a hearing before a FINRA arbitrator. The FINRA arbitrator's award, dated June 3, 2019, set forth: "The Arbitrator recommends the expungement of all references to Occurrence Number 1944264 from registration records maintained by the Central Registration Depository . . . ."
