Sénateur Dalphond se réjouit de la réponse du gouvernement aux amendements du Sénat au projet de loi C-58
Le sénateur Pierre J. Dalphond se réjouit de l'acceptation du gouvernement à 18 des 20 amendements du Sénat au projet de loi C-58, Loi modifiant la Loi sur l'accès à l'information, la Loi sur la protection des renseignements personnels et d'autres lois en conséquence. Ces amendements apportés par le Comité sénatorial permanent des affaires juridiques et constitutionnelles s'inscrivent dans les objectifs du gouvernement d'assurer plus d'accès à l'information par les Canadiens.
Ces amendements obligeront notamment la divulgation proactive, par tribunal, de l'utilisation des postes de dépenses autorisés en vertu de la Loi sur les juges.
L'un obligera, pour la première fois, la divulgation publique des lignes applicables aux dépenses par les juges. Un autre élimine l'exemption pour le Conseil canadien de la magistrature de faire rapport sur ses dépenses et celles de ses membres, permettant d'assurer davantage de transparence. « Cet amendement élimine un trou noir dans la mouture initiale du projet de loi C-58, » a affirmé le sénateur Dalphond.
Finalement, commentant l'ensemble des amendements relatifs à l'utilisation des fonds publics par les juges de nomination fédérale, le sénateur Dalphond a déclaré: « Je suis d'avis que les amendements acceptés représentent un bon équilibre entre les objectifs de transparence et le respect de l'indépendance judiciaire. »

Senator Dalphond welcomes
the government's response to the Senate's amendments to Bill C-58

Senator Pierre J. Dalphond welcomes the government's agreement to 18 out of 20 of the Senate's amendments to Bill C 58, An Act to amend the Access to Information Act and the Privacy Act and to make consequential amendments to other Acts. These amendments made by the Standing Senate Committee on Legal and Constitutional Affairs further the government's objective to increase Canadians' access to information.

Amongst other things, these amendments will require the proactive disclosure, per court, on the use of categories of expenses authorized under the Judges Act.

One of the amendments will require, for the first time, that guidelines applicable to judicial expenses be publicly disclosed. Another eliminates the exemption for the Canadian Judicial Council to report on its expenses and those of its members, which will ensure greater transparency. "This amendment eliminates a black hole that existed in the original draft of Bill C-58," stated Senator Dalphond.

Finally, commenting on all the amendments relating to the use of public funds by federally appointed judges, Senator Dalphond said: "I believe the amendments accepted by the government offer a good balance between the objective of transparency and respect for judicial independence."
