-- Minnesota Criminal Defense Attorney Lynne Torgerson successfully resolved a felony electronic communication relating to sexual conduct with a child case by obtaining a plea agreement with no jail and a stay of imposition of sentence, whereby upon successful completion of probation, the conviction will be deemed to be a misdemeanor as a matter of law. Ms. Torgerson's client was the subject of a sting operation. The State places ads, via a fake persona, for sexual encounters in adult sites. After a person indicates interest, the fake persona then writes they are 15 years old. If a person then exchanges texts with the fake persona attempting to plan a sexual encounter and goes to a meet up address, the person will be charged with felony electronic communication with a child, and, under more recent case law, possibly, attempted felony 3rd degree criminal sexual conduct, which requires predatory offender registration. In Ms. Torgerson's client's case, the outcome in the case avoided any charge of 3rd degree attempted felony third degree criminal sexual conduct, thereby avoiding any registration requirement. Additionally, no incarceration was ordered, and, Ms. Torgerson's client received a stay of imposition of sentence, whereby, upon successful completion of probation, the conviction will be deemed a misdemeanor as a matter of law.
