The "Palm Beach Business Lawyer" scores huge victories in lawsuits for clients

In June 2018, the Law Office of David Steinfeld prevailed for its clients in a Palm Beach County Circuit Court jury trial on a breach of a residential home sale contract in which the sellers did not disclose an unpermitted addition on the home and misrepresented that the windows were all impact windows. The sellers filed for bankruptcy protection in the Southern District of Florida and sought to discharge the almost $225,000 Judgment the Firm obtained for its clients from the jury trial. After a special trial before the judge in the bankruptcy court known as an adversary action, the Firm obtained a Judgment from the Bankruptcy Judge rendering the State Court Judgement not dischargeable for the life of the Judgment. This was a significant victory for the Firm's clients because this and any future bankruptcy can never effect the Judgment allowing the Firm's clients to collect against the sellers' assets for up to two decades.
This has seemingly been a year for lawsuits regarding residential home sales for the Firm, which cases in Florida are considered part of business litigation. In an almost reverse situation of the above matter, the Law Office of David Steinfeld represented the sellers of a home in an alleged breach of the sales contract for the failure to disclose an unpermitted addition. The buyers sued both the husband and wife sellers, but could not prove the requisite knowledge on the part of the wife and were only awarded the out of pocket expenses against the husband. It was these limited that Mr. Steinfeld argued the jury should award to the Plaintiffs anyway. Thus, the result was within what the Firm accurately predicted and the Firm's clients were well-prepared for and satisfied with the outcome. This particular case was an unfortunate one in which the husband checked with the municipality and was told that no permit was required. Almost ten years after the work was done, when the Plaintiffs went to sell the home to someone else, the municipality unfairly reversed itself and required the Plaintiffs to remove the addition despite there being no defect with the construction. That cost them money in a variance process and expenses to tear down the addition. The Plaintiffs sought more than $150,000 in claimed devaluation of the property, but did not succeed in obtaining anything more than what the Firm's clients conceded the Plaintiffs should get.
