NEWPORT BEACH, Calif. - Oct. 25, 2018 - PRLog -- The personal injury law firm of Bisnar Chase stands with Zach Kincaid, father of four, whose 29-year-old wife, Krystil, and unborn daughter, Avalynn, were killed in a Hemet DUI crash Sept. 9, 2018. According to news reports, the suspected drunk driver is pro boxer Marcos Forestal who plowed his BMW head-on into Krystil Kincaid's vehicle.

She became trapped in the vehicle, which was partially on fire. Emergency responders extricated her and airlifted her to a hospital. Her unborn baby girl died and her mother was put on life support, but died the following day. Now her husband is on a mission to hold the driver accountable for his actions. According to Kincaid's Change.org page, the maximum sentence the driver could receive in this case is 10 years because California law doesn't consider an unborn child "a person."

"How do I explain this injustice to my children?" Zach Kincaid asks. "Look at the devastation left behind…and tell me it isn't time for change. We cannot as a society look the other way any longer."

Kincaid also shared a harrowing image of him and the children saying goodbye to his wife and unborn daughter one last time with an open casket, which is posted on the family's GoFundMe page. Kincaid said he heard his wife scream before the crash as they were speaking on the phone just moments before the collision occurred. The couple has an 11-year-old daughter, two sons aged 8 and 4, as well as a 14-year-old daughter from Zach Kincaid's prior relationship.

Forestal, a World Boxing Federation International Super Bantamweight champion, also streamed the aftermath of the crash on Facebook Live reportedly blaming Krystil Kincaid for the crash. The video, which has since been deleted, was recorded by some social media users and was shared online by the El Nuevo Herald.

Zach Kincaid is urging fellow Californians to fight with him for change and to write their representative demanding change so individuals like Forestal can be held responsible.

Kincaid is fighting a noble fight not just for his family, but for other Californians who have suffered irreparable losses like him, said Brian Chase, senior partner at Bisnar Chase.

"For the law not to consider a 36-week-old fully-developed child 'a person' here is simply heartbreaking," he said. "We fully support Zach Kincaid and his family as they mount this noble fight for justice while at the same time having to contend with their terrible loss."
