Is a Phase I All I need to Satisy NJ ' Due Diligence" Requirements When Buying Commercial Land ?

When purchasing a commercial property there are many Environmental Issues that should be considered and failure to complete proper "Due Diligence " may void all your rights under NJ's Innocent Purchaser Act.
 
SOUTH BRUNSWICK, N.J. - Aug. 18, 2018 - PRLog -- Purchasing a commercial property in New Jersey can have some environmental pitfalls. A Environmental Phase I may not protect buyer if an area of Environmental concern is missed,the property is under current remedation or the past remediation has been completed improperly. There also may be areas of "Environmental Concern"  not found. Environmental Systems recommends a Environmental Phase II Assessment be completed to sample possible suspect areas of Soil and Ground Water contamination. GAs Stations and Strip malls should always have a Phase II completed.  Solvents from past dry cleaning activities may have leached into the soils below.  Gas stations have problems if they were remediated were they remediated correctly. Many NJDEP' "o Further Action" letters were sent out and there still may be contamination on the property. Also all properties should have a tank sweep to look for abandoned underground storage tanks.. Interior car lifts should not be overlooked as well they could be leaking.
