NJ Gas Station Property Buyers Beware ! That NJDEP Closure Letter May Not Protect The Purchaser !

A NJDEP " No further Action" letter may not always protect the buyer! Leaking tanks may still be present. A Environmental Assessment is needed to access possible real time contamination.
 
CINNAMINSON, N.J. - July 30, 2018 - PRLog -- The scenario is typically the same. The purchaser is interested a active or a former gasoline station. The current owner has a New Jersey Department of Environmental Protection or a LSRP  RAO letter saying the remediation is
complete or is it . There are few types of letters, Restricted use and no restricted use. Is the letter for the property or only " Areas of Environmental Concern". Recently a property owner from South Jersey contacted  Environmental Systems to close some outstanding monitoring wells. The property owner was thinking of selling the property. The property owner said they had a New Jersey Department  of Environmental Protection " No Further Action " letter. However it was just for the former gasoline tank and did not include a Waste oil tank that was illegally filled in place or closure of more than 15 monitoring wells. The former waste oil tank will probably trigger a new case number and clean-up. Another type of ' NJDEP " No Further Action " letter is a ' Conditional Type that has a "Deed  Notice" A Deed Notice means that there still may be contamination on site exceeding the NJDEP Soil or Ground Water Clean- up standards and that every two years existing wells must be monitored until it can be demonstrated by the Responsible Party that the " Area of concern or site has been remediated.  Environmental Systems always recommends a comprehensive review of all ' No Further Action Letter or RAO letter that may have been generated for the site. A Soil and Ground Water investigation should be completed to verify if any contamination still exists and that the engineering controls that may be in use are still protective of health and not have increased.
