Mark Pompeo Files Law Suit against FINRA and Opposes Motion to Dismiss

Awaited Decision Could Be Any Day and Could Result in Landmark Case

SCITUATE, Mass. - Feb. 27, 2017 - PRLog -- Mark Pompeo, a Scituate, Mass., resident and former securities broker, recently filed a complaint against the Financial Industry Regulatory Authority (FINRA) and Smarsh, Inc. , a digital archiving company based in Portland, Ore., in D.C. District Court.  The suit alleges that both FINRA and Smarsh conspired against him by tampering with his electronic communications in an effort to accuse him of securities laws violations in 2013.  Neither FINRA nor Smarsh have denied the accusations in this case.

In response, attorneys for FINRA and Smarsh asked the presiding judge to dismiss the complaint that the two conspired against Pompeo.  Pompeo then opposed the defendants' Motion to Dismiss, which was submitted by Constance J. Miller, Esq., counsel for Pompeo and an additional plaintiff, Thaddeus North, on January 17, 2017.

According to the opposition to the motion for dismissal of the case, the evidence points to the conclusion that FINRA procured Smarsh to intercept the plaintiffs' private and personal email and redirect it to servers that FINRA owns, operates, or controls; the combined actions of FINRA and Smarsh occurred outside of the regulatory process and caused harms to both Pompeo and North.  (Pompeo was required to pay a $5,000 fine and was suspended for 10 business days; he has since been unable to secure full-time employment in the industry.)

A decision on the case is expected any day.
