PRLog -- Uber's motion to dismiss a class action complaint filed by a North Carolina driver has been denied. The complaint, filed in a North Carolina federal court, alleges that Uber incorrectly classified drivers as independent contractors to avoid reimbursing drivers for costs associated with driving for Uber.
Uber filed a motion to dismiss the complaint, claiming that the plaintiff failed to allege facts to prove he was an employee and not an independent contractor. After reviewing written documents and hearing oral argument a federal judge denied Uber's motion.
Attorney Brittany Weiner, whose law firm filed the complaint on behalf of the drivers, said, "The classification as independent contractors forced Uber drivers to use their own money to pay for their cars, gas, insurance and repairs." "Employers must reimburse work-related expenses paid by employees – by classifying drivers as independent contractors, Uber violated North Carolina law by failing to reimburse Uber drivers for their expenses," Ms. Weiner added.
