Circuit assembled its entire panel of judges en banc to decide these questions, among others, and there is an expectation that this litigation can escalate to the Supreme Court. "President-elect Trump has promised to eliminate the Clean Power Plan. Whether and how an incoming Trump administration will act to eliminate, change, roll back, or respond to the challenge of the CPP in court will be worth watching in the upcoming months," continued Mr. Williams.
