PARRAMATTA, Australia - Sept. 19, 2016 - PRLog -- In our firm we deal with many of these circumstances, in one of our recent matters, there was a de-facto relationship with two children. One of our clients is the father of these two children. He came to us because the mother was refusing to let him see his young daughter and baby son. He had previously represented himself at Court.

Interim orders were made for him to spend time with his daughter twice a week, but no orders were made regarding his 10 month old son. The mother refuses to let him see his 10 month old son, the only time he gets to see his son is on change over. Our client has not spent any time with his son since his birth. Our client is stressed as his son's age is a critical age of development when it is important for him to spend time with people who are significant to him.

In this particular case, there was a 5 year old daughter and a 10 month old son. One day our client woke up to find that his children were gone and his partner had gone. Our client's partner had separated from him and taken the children. Soon after our client's ex-partner had filed an Apprehended Violence Order against our client .The mother says that the father should not see the children and should be supervised if he does see the children. As a result of this, our client has been unable to contact and see his children because the mother claims that he is abusive, this is unfair because this allegation as untrue and anyone can make false allegation to the police, whether it is true or not is to be determined in court.

Since separation our client has only been allowed to see his daughter twice a week and with no overnight stays and an hour long skype conversation from 6pm-7pm each Tuesday and Thursday. He has had no luck with being able to see his 10 month old son.

On one particular instance our client was at court for a proceeding. Our client saw his son and he asked the family consultant if he could hold his son, he only got to hold his son for about a minute. As there was some issue with the mothers lawyer. On another occasion, our clients whole family where at a police station for unknown reasons. Whilst they were at the police station, our client went to lean over and touch his son's head, as he hadn't seen his son for a long time. His ex-partner slapped his hand away. On another day, our client's daughter told the family consultant that she was nervous to show any expressions toward her father as her mother was watching and could possibly get angry with her for having fun with her father.

It has been proven that his relationship with his daughter is a strong. It has also been proven there has been no issue when seeing his daughter on their visits. If visits with his daughter are fine, why should there be any issues with his son?

We represented our client at an interim hearing where we successfully achieved new parenting orders for our client. Within these new orders made by the court, the main effects added to the order was that he could see his 10 month old son. Although, as we have successfully achieved this, the mother has unfortunately not made any contact to get these orders underway which has lead our client not be able to see his children as per the parenting order.

We now have liberty to relist the matter urgently at court. As this will speed up the process of finalising the orders. His will also ensure that the father is able to spend time with his 10 month old son as per the orders.
