Tom is a former electrical engineer with over 20 years of experience with patents—as a patent-support engineer, as a registered U.S. patent agent, and as a patent attorney. Tom has extensive experience in patent preparation and prosecution and in supporting patent litigation. Tom also has experience with USPTO post-grant procedures such as inter partes reexaminations and Inter Partes Reviews (IPRs). During his engineering career, Tom worked for AT&T Bell Laboratories and Ericsson Inc. in digital signal processing and communications. Event Synopsis:

In the nearly five years of its implementation, the America Invents Act (AIA) of 2011 continues to bring in significant changes to the patent system. The US Patent and Trademark Office's (USPTO's) Amendments to the Rules of Practice for Trials Before the Patent Trial and Appeal Board, published earlier this year, is one of the most significant developments.

The final rule, which became effective in May, amends the existing consolidated set of rules relating to the trial practice for inter partes review (IPR), post-grant review (PGR), the transitional program for covered business method patents (CBM), and derivation proceedings that implemented provisions of the AIA providing for trials before the USPTO. These proceedings provide patent challengers the opportunity to challenge a patent in a more expedient and less expensive manner than district court litigation. Despite criticisms of the rules as being a minor alteration to the confusing nature of these proceedings, it is certain that the new rules will affect strategies for both petitioners and patent owners.
