Event Synopsis: In the nearly five years of its implementation, the America Invents Act (AIA) of 2011 continues to bring in significant changes to the patent system. The US Patent and Trademark Office's (USPTO's) Amendments to the Rules of Practice for Trials Before the Patent Trial and Appeal Board, published earlier this year, is one of the most significant developments. The final rule, which became effective in May, amends the existing consolidated set of rules relating to the trial practice for inter partes review (IPR), post-grant review (PGR), the transitional program for covered business method patents (CBM), and derivation proceedings that implemented provisions of the AIA providing for trials before the USPTO. These proceedings provide patent challengers the opportunity to challenge a patent in a more expedient and less expensive manner than district court litigation. Despite criticisms of the rules as being a minor alteration to the confusing nature of these proceedings, it is certain that the new rules will affect strategies for both petitioners and patent owners. In this two-hour LIVE Webcast, a panel of thought leaders and practitioners assembled by The Knowledge Group will help firms and individuals better understand the implications of the new rules. Some of the major topics that will be covered in this course are: · Patent Owner Submission of New Testimonial Evidence with Preliminary Response · Proper Use of new (non-petition cited) evidence in post-grant proceedings · Phillips-Like Claim Construction for Patent Claims that Expire Before the Proceeding Concludes · Sufficiency of evidence to show a motivation to combine to establish a prima facie case of obviousness · Practice Tips For Expert Declarations In AIA Post Grant Proceedings · Strategic consideration regarding petitioner's expert rebuttal declaration · Word-Count Limits Instead of Page-Count Limits for Major Briefing · Strategic considerations in preparing for oral argument · Rule 11-Type Certifications for Papers Filed in Proceeding About The Knowledge Group, LLC/The Knowledge Congress Live Webcast Series The Knowledge Group was established with the mission to produce unbiased, objective, and educational live webinars that examine industry trends and regulatory changes from a variety of different perspectives.
