Family Law Case: Separated Parents Re-Locating Overseas with Children

Our client was previously married until things started to break down and subsequently led to their separation late in 2014. They had a daughter together during their relationship and we wanted the best result for the wife and the child.
 
SYDNEY - June 30, 2016 - PRLog -- Our law firm deals with these matters quite often, our firm acts for the mother in this particular case.

Our client was married to her partner for around 3 years, until things started to break down in their marriage, which eventually lead them to separating late in 2014. They had a daughter together during their relationship, she is around four years old.

Before they separated our client received a fantastic job offer in a foreign country, the job's contract was for about 2-3 years. Due to the new job offer, the couple spoke about new family arrangements to move overseas all together for the period of the job offer. Our client's ex-husband was very encouraging towards her getting the new job, and really encouraged her to accept the offer. As she was constructing the accepting offer her husband was by her side telling her to accept. Unfortunately not long after this, the couple split up before moving overseas.

After separation the couple initially had verbal agreements as to when either of them would see their daughter. Throughout the relationship our client was the one who supported their child, as her ex-husband did not have a job. Our client with the help of her mother cared for her child. Our client was working full-time, once she finished work she would come home and make dinner and then feed her daughter, bathe her and would put her to bed. Her ex-husband didn't do much to help out.

Our client's ex-husband has now filed an order for recovery. This is seen as unnecessary due to the fact that our client's ex-husband already knew that his ex-wife and child were going to re locate to a foreign country due to the new job. Our client is the primary care giver, she has been supporting her child since she was born has her ex-husband has not had a job for a year or so. Our client's ex-husband is also not paying any child support. Our client is also paying all the expenses such as the bills including the mortgage repayments and the cost of their child's day care.

Our client and her daughter are happily living overseas, with her new job. Our clients daughter is about to start school within a week or so.

Our firm will be responding to the father's court orders. We will be asking the court to consider our clients situation and to create court orders to allow our clients daughter to remain living with her. The court will look to see if the country that they are living in is a convention country which means that Australian court orders have to be followed accordingly.

Our client has intentions to move back to Australia as soon as her contract has ended. Our client has not sold her property here in Australia she is renting it. All her immediate family are living in Australia. Our client also doesn't mind if her ex-husband visits them overseas to see his child. All of the above helps our firm to receive an order from the courts to allow our clients daughter to remain living with her.
